O.K., so your Mortgage Company agreed to allow you to do a short sale or maybe to accept a deed in lieu... But they didn't tell you or maybe you didn't realize that you might have to pay income tax on any resulting deficiency. Now you've received a 1099C for $50,000 or $100,000 or some other amount and you don't know what to do.

Here is the IRS's theory on why you owe tax on the deficiency: When you first got the loan, you didn't owe taxes on it because you were obligated to pay the loan back (it was not a "gift"). However, when you didn't pay the loan back and the debt was forgiven, the amount that was forgiven became "income" on which you now owe tax.

The IRS learns of the deficiency when the lender sends it an IRS Form 1099C, which reports the forgiven debt as income to you. 

Here are the rules:

• Loans for your primary residence. If the loan was secured by your primary residence and was used to buy or improve that house, you may generally exclude up to $2 million in forgiven debt. This means you don't have to pay tax on the deficiency.
• Loans on other real estate. If you default on a mortgage that's secured by property that isn't your primary residence (for example, a loan on your vacation home or investment property), you'll owe tax on any deficiency.
• Loans secured by but not used to improve primary residence. If you take out a loan, secured by your primary residence, but use it to take a vacation or send your child to college, you will owe tax on any deficiency.

For me, PASSING GAS is like saying I LOVE YOU. I’ve been dating my girlfriend for the past 5 years. I love her very much and I know she loves me. We’ve discussed getting married and having children at least 15 times and we’ve been living together for the past 1,278 days (about 3.5yrs), but the reason I haven’t asked her to marry me is because I don’t know if I can truly trust her. I’m old school, so I don’t know if I can trust her if she doesn’t feel comfortable enough around me to PASS GAS. To me, it feels like she is hiding a part of who she is. How can you say you LOVE someone, when you can’t be YOURSELF around them? Am I being silly for thinking that PASSING GAS is the best way to say I LOVE YOU?? What do you think? WHAT SHOULD I DO?? Bryan says: Lady, if that's the best resolution you could come up with, I'm worried about you. What about being a better mother to your daughter, being a better person or losing weight? Aren't these typical resolutions that people make? Do you have any idea how happy you've made the 14, 15, and 16 year old boys at her school, church, or sports club? C'mon lady, at 14, your daughter needs to be focused on SCHOOL and not BOYS.

Munch says: OMG Bryan, the dark ages have been over for centuries now. We're in 2014 for crying out loud. When are parents like "YOU," going to realize that.....what our parents did with us won't work with these teenagers? MY PARENTS never had to compete or deal with Facebook, Twitter, Instagram, or SEXTING. And if we're going to be parenting in 2014, then we're going to need a 2014  mentality. Would I allow my 14yr old daughter to have a boyfriend, ABSOLUTELY. I want to be the one educating her on relationships, on what to expect, on what boys want, and on what VALUES and PRINCIPLES our family stands for. But you can continue to live under a rock Bryan. Let's hope when you're ready to come out, your backward thinking hasn't cost you a relationship with your daughter.

Bryan says: Munch let's just get right to it....this is all about SEX. The reason why PARENT'S LIKE ME don't want their 14yr old daughters having a boyfriend is because we don't want them having SEX. Doesn't mean that all of them will, but that's not a chance that I want to take. I don't think at 14, you have the emotional maturity to deal with a relationship that could lead to SEX. Now I can talk to my daughter and educate her on a number of things, but HUMAN NATURE, CURIOSITY, and PEER PRESSURE are things that we can't control. So call me BACKWARDS or whatever you want to call me, but if the government is not willing to give my 14yr old a license to drive...I don't see why I have to give her a license to date or have a boyfriend.
